Filing Procedure

Procedures for Filing and Registration of Claims at the Tribunal For Consumer Claims Malaysia (TCCM)

Briefly, the procedures on filing and registration of claim are as follows:

  1. The claim shall be made by way of Statement of Claim (Form 1), which may be obtained for free at the nearest Tribunal Registry Office or may be downloaded from the webpage https://ttpm.kpdn.gov.my;

  2. The Claimant shall complete form 1 in 4 copies and subsequently file them at the nearest Tribunal Registry Office with a filing fee of RM5.00. An official receipt will be issued to the Claimant;

  3. Form 1 will be processed by the Tribunal Officer and 2 copies will be returned to the Claimant. One copy is for the Claimant’s safe keeping and the other copy is to be served by the Claimant to the Respondent;

  4. The service of Form 1 to the Respondent may be made as provided under Regulation 15 of the Consumer Protection (The Tribunal For Consumer Claims) Regulations 1999 . If service is made by way of e-mail, the Claimant shall make the service as provided under The Tribunal For Consumer Claims (Service of Notice or Document By Electronic Communication) Procedures 2024;

  5. The Respondent who receives Form 1 shall file the Statement of Defence and Counter-Claim (Form 2). Form 2 may be obtained at no charge at the nearest Tribunal Registry Office with a filing fee of RM5.00. An official receipt will be issued to the Respondent or may be downloaded from the webpage https://ttpm.kpdn.gov.my;

  6. The Respondent shall file Form 2 in 4 copies at the same Tribunal Registry Office where Form 1 is filed. Form 2 shall be filed within 14 days after the service of Form 1 by the Claimant;

  7. Form 2 will be processed by the Tribunal Officer and 2 copies will be returned to the Respondent. One copy is for the Respondent’s safe keeping and the other copy is to be served by the Respondent to the Claimant;

  8. If there is a counter-claim, the Claimant shall file a defence or reply to the counter-claim in the Defence to Counter-Claim (Form 3). Form 3 may be obtained at no charge from the Tribunal Registry Office or may be downloaded from the webpage https://ttpm.kpdn.gov.my;

  9. The Claimant shall file Form 3 in 4 copies at the same Tribunal Registry Office where Form 1 and Form 2 are filed ; and

  10. Form 3 will be processed by the Tribunal Officer and 2 copies will be returned to the Claimant. One copy is for the Claimant’s safe keeping and the other copy is to be served by the Claimant to the Respondent.
